1. Administrative & Digital
1.1 Website Terms of Use
All content on this website is protected by copyright and intellectual property rights owned or licensed by us. You may view, download, and print content for personal, non-commercial purposes only.
1.2 Privacy Policy: Data Collection and Use
We collect personal information (including name, contact details, and health information) to manage bookings and ensure your safety. Health information is considered sensitive and is collected with your explicit consent to assess your physical readiness for exercise. We do not share, sell, or distribute any of your personal or health data to third parties.
1.3 Data Security and Third-Party Platforms
We use trusted third-party platforms for bookings and payments. While we take reasonable steps to protect your data, we are not responsible for interruptions or errors caused by these platforms, to the extent permitted by law.
2. Financial, Bookings & Refunds
2.1 Bookings and Payments
Bookings must be made via our online booking platform. Payment is required in full at the time of booking. All prices are in AUD and include GST.
2.2 Cancellation and No-Show Policy
Cancellations must be made at least 12 hours prior to the scheduled class start time.
- Late Cancellations/No-Shows: Will result in the forfeiture of the class credit.
- Excessive Cancellations: We reserve the right, at our absolute discretion, to restrict future purchases or cancel memberships if a client's cancellation frequency is deemed disruptive to studio operations.
2.3 Class Pack Expiry, Transfers and Guest Passes
- Class packs are non-transferable. While they currently do not have an expiry date, we reserve the right to implement an expiration period by providing 30 days' written notice.
- Guest passes can currently be redeemed by any individual, subject to availability. However, we reserve the right to modify, amend, restrict, or terminate this policy. This includes, but is not limited to, altering eligibility criteria, limiting pass availability, or introducing promotional restrictions at any time and without prior notice.
- Guest passes are strictly valid for one-time use per individual. Any unauthorized use, duplication, or circumvention of this policy may result in the immediate cancellation of the pass and revocation of studio access.
2.4 Membership Pauses and Cancellations
- No Minimum Term: Memberships operate on a weekly recurring basis with no minimum commitment period.
- Cancellations: You may cancel at any time via your online profile. No refunds are issued for payments already processed.
- Pauses: Must be requested via email to info@ikigaiwellbeing.com.
2.5 Refunds
Consistent with Australian Consumer Law, refunds are not provided for change of mind. Refunds or credits are issued only where required by law or at the discretion of management for documented medical reasons.
3. Physical Experience: Safety & Hygiene
3.1 Age Requirements
The minimum age to participate in classes is 16 years. All participants must be 16 years of age or older, including Guests and Family Members.
3.2 Medical Participation and Pregnancy
By attending, you warrant that you are in good physical health. You must inform the instructor of any injuries or pregnancy prior to the start of class.
- Medical Clearance: We reserve the right to request written medical clearance from a qualified health professional if we feel it is required to ensure your safety or the safety of others.
- Pregnancy: While we do not strictly require a medical clearance for pregnancy, we reserve the right to move pregnant clients to specialised pre-natal classes or specific sessions at our discretion.
- Right to Refuse: We reserve the right to refuse entry if we reasonably believe a client's health or behaviour poses a risk to themselves or others.
3.3 Late Arrivals and Hygiene
- Late Arrivals: To maintain safety and avoid class disruption, clients arriving more than 5 minutes late may be refused entry and will forfeit the session.
- Grip Socks: Specialised grip socks are mandatory for all reformer classes for hygiene and safety.
4. Legal Protections
4.1 Limitation of Liability
Nothing in these terms excludes or restricts any guarantees or remedies you are entitled to under the Australian Consumer Law. To the maximum extent permitted by law, we exclude liability for any indirect or consequential loss arising from your use of our services.
4.2 Assumption of Risk
You acknowledge that Pilates involves inherent physical risks. You voluntarily assume these risks and release Ikigai Wellbeing Pty Ltd from liability for injuries arising from standard participation.
4.3 Media Consent
We may occasionally take photos or videos for marketing purposes. By attending, you consent to your image being used. If you prefer not to be filmed, please provide a verbal opt-out to your instructor before the class begins.
4.4 Governing Law
These terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland.
